Introduction
Welcome to Hooked by Hand (“we,” “our,” or “us”). These Terms and Conditions govern your access to and use of our website, www.hookedbyhand.com, and any purchases you make of our handmade collectible dolls and accessories (collectively, “Products”). By accessing our site or purchasing our Products, you agree to be bound by these Terms.
1. The Products & Our Business Model
1.1 Nature of Products: All Products, including dolls under the “Ceile Heritage Dolls” collection and their accompanying dresses, are handmade, limited edition, and/or made-to-order heirloom collectibles. They are not mass-produced toys.
1.2 Limited Availability: Due to the nature of our craft, inventory is extremely limited. We may release items in small batches or on a made-to-order basis. All product listings are subject to availability.
1.3 Product Representation: We take great care to represent our Products accurately through photography and descriptions. However, please note:
* Each piece is unique due to its handmade nature. There may be slight, non-material variations in color, texture, or detailing from the images shown, which are considered part of the item’s character and not defects.
* Minor imperfections are inherent to handmade craftsmanship and are not considered flaws.
2. Orders & Payment
2.1 Order Acceptance: Placing an item in your cart or completing the checkout process does not constitute our acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including but not limited to: Product availability, errors in Product or pricing information, or suspected fraud.
2.2 Pricing: Prices are listed in US Dollars (USD). We reserve the right to correct any pricing errors at any time, even after an order has been placed.
2.3 Payment: Full payment is required at the time of purchase to secure your order and begin the production process.
3. Production, Shipping & Delivery
3.1 Processing Time: As each item is made-to-order or part of a limited batch, please allow 8-12 weeks (approx. 2-3 months) from order confirmation for production, quality checks, and packaging before your item ships. This timeframe is an estimate and not a guaranteed delivery date.
3.2 Shipping: We ship worldwide via insured and tracked services. Shipping costs are calculated at checkout and are the customer’s responsibility.
3.3 Delivery & Import Duties: You are responsible for providing a complete and accurate shipping address. We are not liable for delays or non-delivery caused by incorrect addresses, customs holds, or local import duties and taxes, which are the recipient’s sole responsibility.
4. Returns, Refunds, & Damages
4.1 All Sales Are Final: Due to the custom, handmade, and limited-edition nature of our Products, we do not accept returns, exchanges, or offer refunds for change of mind.
4.2 Damages & Defects: If your Product arrives with a verifiable manufacturing defect or is damaged in transit, you must contact us within 7 calendar days of delivery. Please provide your order number and photographic evidence. We will, at our discretion, arrange for a repair or replacement, provided the item is returned to us in its original condition.
4.3 Refusal of Shipment: If you refuse a delivery, you will be responsible for the original shipping costs and any return shipping costs. A refund for the Product cost, minus these fees, will only be issued once the undamaged Product is returned to our studio.
5. Intellectual Property
5.1 All content on this site, including designs, photographs, text, and the “Hooked by Hand” and “Ceile Heritage Dolls” names and logos, is our intellectual property. You may not use, copy, or reproduce any content for commercial purposes without our explicit written permission.
6. Limitation of Liability
6.1 To the fullest extent permitted by law, Hooked by Hand shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the site or Products.
6.2 Our total liability for any claim related to a Product is limited to the purchase price of that Product.
7. Governing Law
